Form 5472: the definitive guide for foreign LLC owners
If you own a US LLC and are not a US citizen, Form 5472 is probably the most important (and most overlooked) tax document of your year.
What is Form 5472?
Form 5472 is an information return that the IRS requires from every US company with at least 25% foreign ownership. For single-member LLCs with a non-US owner, it must be filed together with a pro-forma 1120.
What happens if I don't file it?
The penalty is $25,000 for each Form 5472 not filed or filed incomplete. The IRS can also impose additional penalties for each month of delay. This is not a theoretical penalty — the IRS enforces it systematically.
How Incorpo prepares it
With the Essential plan, Form 5472 is included in the annual price. Our team prepares it, you sign it digitally from the dashboard, and we submit it to the IRS. A US CPA charges $1,500-$2,500 for this alone — with Incorpo Essential at EUR699/year it is already included.
Incorpo (ORION LABS LLC) is a document filing service, not a law firm. The information in this article is for informational purposes and does not constitute legal or tax advice.
